Agreement to Terms
By accessing Maintaro.com ("the Site"), you agree to these Terms of Service. If you disagree with any part, you may not access the Site.
Service Description
Maintaro is a product of Wheatley Labs Ltd and is currently in pre-launch. The Site provides:
- Information about our upcoming property maintenance management platform
- A waitlist for early access to the product
- General enquiry and contact capabilities
No service level guarantees apply during pre-launch. The product is not yet available for use.
If we provide access to the Maintaro platform or related services (the "Service"), these Terms apply to your use of the Service unless we agree otherwise in a written contract.
Availability & Service Levels
We do not provide any service level agreement (SLA) or uptime commitment unless expressly agreed in a custom Enterprise subscription agreement signed by Wheatley Labs Ltd.
The Service may be unavailable or interrupted from time to time, including for maintenance, upgrades, outages, third-party failures, or events outside our control.
If an SLA is provided in a signed Enterprise agreement, any service credits specified in that agreement are your sole and exclusive remedy for SLA breaches.
Beta & Early Access
Any beta, preview, or early access features are provided on an "as is" and "as available" basis and may be modified or discontinued at any time. Beta features may be incomplete, contain errors, or experience downtime.
Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information
- Abuse or spam our forms or contact mechanisms
- Attempt to scrape, harvest, or extract data from the Site
- Interfere with the Site's operation or security
- Use the Site for any unlawful purpose
Abuse & Misuse
You must not use the Site or Service to:
- Upload, transmit, or store malicious code or malware
- Attempt to gain unauthorized access to any systems or data
- Probe, scan, or test the vulnerability of our systems
- Send spam, phishing, or unsolicited marketing messages
- Infringe intellectual property or privacy rights
- Use the Service to process unlawful or sensitive data without authorization
We may suspend or terminate access for abuse, security risk, or violation of these Terms.
Waitlist
By joining the waitlist:
- You consent to receive email updates about Maintaro's launch
- You can unsubscribe at any time via the link in our emails
- Waitlist position does not guarantee access or pricing
- We reserve the right to modify or cancel the waitlist at any time
Intellectual Property
All content on the Site, including text, graphics, logos, and software, is the property of Wheatley Labs Ltd and protected by UK and international copyright laws. You may not:
- Reproduce, distribute, or create derivative works without permission
- Use our branding, logos, or trademarks without written consent
Disclaimer of Warranties
The Site is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness of information
- Uninterrupted or error-free operation
If we provide the Service, it is also provided "as is" and "as available" to the maximum extent permitted by law.
No Reliance
Information provided on the Site or through the Service is for general information purposes only. You acknowledge that you do not rely on any statements, forecasts, or representations that are not expressly set out in these Terms or in a signed written agreement with Wheatley Labs Ltd.
Customer Responsibilities
You are responsible for maintaining appropriate backups of your data and for your compliance with all applicable laws and regulations in connection with your use of the Site or Service.
Limitation of Liability
To the maximum extent permitted by law, Wheatley Labs Ltd shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Any damages arising from your use of or inability to use the Site or Service
- Any downtime, outage, or unavailability of the Site or Service
- Any failures caused by third-party services, networks, hosting providers, or internet disruptions
- Any loss, corruption, or unauthorized access of data
Our total aggregate liability for all claims arising out of or relating to the Site or Service shall not exceed the fees paid to Wheatley Labs Ltd for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
Force Majeure
We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, power failures, strikes, cyberattacks, or failures of third-party services or networks.
Indemnification
You agree to indemnify and hold Wheatley Labs Ltd harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.
Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of external sites.
Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the Site or email.
Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wheatley Labs Ltd regarding use of the Site.
